Speakeasy Bookings Inc. LLC (“Speakeasy Bookings Inc.,” “we,” or “us”) respects your privacy and is committed to protecting it through our compliance with this privacy policy (the “Privacy Policy”). This Privacy Policy describes the types of information, including personal information, that Speakeasy Bookings Inc. may collect from you or users of your Speakeasy Bookings Inc. account (collectively, “you” or “your”) or that you may provide when you visit www.speakeasygo.com, any predecessor or successor websites established by Speakeasy Bookings Inc. which reference this Privacy Policy, and any Speakeasy Bookings Inc. applications (collectively, the “Site”) or access or use the Speakeasy Bookings Inc. Reservation (as defined below) service or in-person ordering and payment service offered through the Site (collectively, the “Service”). It also describes our practices for collecting, using, maintaining, protecting and disclosing that information. As used herein, a “Speakeasy Reservation” shall mean any (i) reservation, (ii) ticket purchase, (iii) waitlist reservation, and (iv) any other booking option available to you through Speakeasy Bookings Inc..

This Privacy Policy applies both to persons who register or establish an account with Speakeasy Bookings Inc. (“Account”) and to casual browsers of the Site. This Privacy Policy applies to information we collect on the Site and in email, text and other electronic messages between you and Speakeasy Bookings Inc. This Privacy Policy does not apply to information collected by Speakeasy Bookings Inc. offline or by any third party, including through any application or content that may link to or be accessible from the Site.

This Privacy Policy is incorporated into and made a part of Speakeasy Bookings Inc.’s Terms of Use.

The Information Speakeasy Bookings Inc. Collects, and How Speakeasy Bookings Inc. Collects It

When you create an Account, make a Speakeasy Bookings Inc. Reservation, or place or pay for an order in-person

When you register for an Account on Speakeasy Bookings Inc., you provide information about yourself, including your name, email address, phone number, physical address, birthday and other important dates, company name, job title, a photograph, credit card information, cuisine, beverage and hospitality preferences, and dietary restrictions, including allergies and aversions. If you register for an Account using a third party, such as Google, Instagram or Facebook, you authorize us to collect and use any information that you agreed such third party could provide to us in your privacy settings with such third party. You can modify your privacy settings with such third party directly.
When you make a Speakeasy Bookings Inc. Reservation, we collect information about your transaction, including the name and location of the entertainment venue, restaurant, nightclub, bar, winery, brewery, or other venue (“Business”) with which you made the Speakeasy Bookings Inc. Reservation, the date and time of your Speakeasy Bookings Inc. Reservation, your credit card information, and the amount you pay.
When you place or pay for an order in-person through Speakeasy Bookings Inc., we collect information about your transaction, including the name and location of the Business at which you order, the date and time at which you order and pay, the experiences or items you order, your credit card information, and the amount you pay.

When you communicate with the Speakeasy Bookings Inc. team

When you communicate with us through the Site or via email or text, we keep a record of your communications.

Through cookies and other automatic data collection technologies

Speakeasy Bookings Inc. uses automatic data collection technologies to collect information when you visit and use the Site. Information collected by Speakeasy Bookings Inc. through these technologies includes your IP address, the city in which your IP address is located, the type and version of browser you are using, the website from which you came, your language preference, and the way in which you interact with the Site. How Your Information Is Used by Speakeasy Bookings Inc., and With Whom Speakeasy Bookings Inc. Shares It

To the furthest extent permitted by law, by voluntarily providing us with your email address and phone number when you create an Account or at any other time, you are expressly opting-in to receive email, text messages (SMS and MMS) related to your Speakeasy Bookings Inc. Reservations from Speakeasy Bookings Inc. and Businesses, and push notifications from Speakeasy Bookings Inc. relating to the Site and Services. You will have the opportunity to avoid receiving text messages related to a Speakeasy Bookings Inc. Reservation when creating the Speakeasy Bookings Inc. Reservation. When you provide your email address and phone number to Speakeasy Bookings Inc., you warrant that you are the current subscriber or authorized user of such accounts. You acknowledge that emails, text messages, and push notifications may be sent using automated technology, and that text messages between you and a Business relating to a Speakeasy Bookings Inc. Reservation you made are not promotional messages. You acknowledge and agree, without limitation, that all agreements, notices, disclosures, and other communications that we provide you electronically satisfy any legal requirement that such communications be in writing. You further acknowledge and agree that messaging and data rates may apply and that you are solely responsible for paying such rates. Please contact your mobile phone carrier for details. If you opt in to using location services for any Speakeasy Bookings Inc. applications, we may collect and store information about your current location in order to enhance and customize your experience using such Speakeasy Bookings Inc. applications (e.g., by showing you nearby Businesses).

We may use and disclose aggregated information about our users, and information that does not identify any individual, without restriction. We may disclose information that we collect or you provide as described in this Privacy Policy (i) to any affiliates; (ii) for internal marketing and demographic studies; (iii) to our third-party service providers and partners (Businesses, payment processors, third-party partners, analytics companies, third parties who deliver marketing messages and advertisements on our behalf, and strategic partners); (iv) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of Speakeasy Bookings Inc.’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which information held by Speakeasy Bookings Inc. about the Site is among the assets transferred; (v) to our investors; (vi) to fulfill any purpose for which you provide it; and (vii) to any other third parties with your consent.

Where Your Information Is Stored

Currently, Speakeasy Bookings Inc. maintains and stores your information on servers located within the United States. Review and Correction of Your Information and Deletion of Your Account

We will retain your information for as long as your Account is active or as needed to provide you with the Services. We may retain aggregated information about our users, and information that does not identify any individual, without restriction.

You may review and change your information by logging into the Site and visiting your Account. You may also email our Privacy Officer at contact@speakeasygo.com to request access to, correct or delete any information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

You may delete your Account by logging into the Site and visiting your Account or by emailing our Privacy Officer at contact@speakeasygo.com. Even if you delete your Account, we may retain your information in our electronic data and other files and use your information as necessary to maintain the security, integrity and effective operation of the Site, to comply with our technical and legal obligations, to resolve disputes and enforce our agreements and policies, and to take other actions required or permitted by law. Deletion of your Account will not remove your interactions with other Site users from the Site. If you have interacted with other users of the Site, including but not limited to transferring a reservation, such interactions may remain viewable in cached and archived pages, or might have been copied or stored by other users of the Site. In addition, if certain information has already been provided to third parties as described in this Privacy Policy, retention of that information will be subject to those third parties’ policies.

How to Opt Out of Having Your Information Used or Shared

If you would like to opt-out of having your information shared with parties outside of Speakeasy Bookings Inc., its affiliates, and its third-party service providers and partners, except to the extent required by law, court order, or as requested by other government or law enforcement authority, please email our Privacy Officer at contact@speakeasygo.com.

If you’d like to have your email removed from our promotional mailing list or a Business’s promotional mailing list, please email our Privacy Officer at contact@speakeasygo.com. You may also opt-out of promotional email messages from Speakeasy Bookings Inc. or a Business by following the instructions contained within the emails sent to you by Speakeasy Bookings Inc. or a Business, respectively.

You may opt-out of receiving text messages related to a given Speakeasy Bookings Inc. Reservation at any time by replying to any text message received with “END” or emailing our Privacy Officer at contact@speakeasygo.com. You will also have the opportunity to avoid receiving text messages related to a given Speakeasy Bookings Inc. Reservation when creating the Speakeasy Bookings Inc. Reservation. You understand and agree that you will have to repeat the opt-out process for any Speakeasy Bookings Inc. Reservation for which you have agreed to receive text messages, but for which you no longer wish to receive them. You may opt-out of receiving text messages for all of your Speakeasy Bookings Inc. Reservations by emailing our Privacy Officer at contact@speakeasygo.com.You acknowledge and agree that you may continue to receive text messages for a short time while an opt-out request is processed.

You can use the settings on your mobile device to enable or turn off mobile push notifications from Speakeasy Bookings Inc. and location services for any Speakeasy Bookings Inc. applications. If you choose to share your information with any third-party website through buttons provided on the Site (e.g., you may share your reservation information on Facebook and Twitter), you will post such information to such third-party website outside of the Site. Because we cannot control the activities of third parties, including without limitation, Businesses, third-party payment processors and social networks, we are not responsible for any use of your information by such third parties, and we cannot guarantee that they will adhere to this Privacy Policy. If you visit or share your information with a third-party website that is linked to the Site, you should consult that website’s privacy policy before providing any personal or other information.

Communicating with Third Parties Through the Site

You may choose to disclose information about yourself through communications with third parties through the Site; for example, if you choose to transfer a reservation through the Site. Such information is public information, and there is no expectation of privacy or confidentiality. Speakeasy Bookings Inc. complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively. Speakeasy Bookings Inc. has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this Privacy Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Speakeasy Bookings Inc. has further committed to refer unresolved Privacy Shield complaints to JAMS, an alternative dispute resolution provider located in the United States. If your complaint is not resolved by Speakeasy Bookings Inc. or JAMS, you may, under certain conditions, invoke binding arbitration for complaints regarding Privacy Shield compliance.
