Welcome back to PROJECT LAZARETH, fashion week is almost upon us and with that comes fire outfits, celebs everywhere and most importantly amazing parties to get drunk and mess up your new designer pants at ;). well this fashion week we're gonna be doing just that!

PROJECT LAZARETH

EVENT TERMS & CONDITIONS

These Event Terms & Conditions (“Terms”) become effective immediately upon the purchase, possession, acceptance, or use of a ticket to PROJECT LAZARETH (the “Event”).

By purchasing, possessing, accepting, or using a ticket to the Event, you (“Customer,” “Ticket Holder,” or “Attendee”) acknowledge that you have read, understood, and agreed to these Terms.

These Terms constitute an agreement between you and PROJECT LAZARETH, and their respective owners, organizers, promoters, producers, affiliates, contractors, agents, representatives, and authorized personnel (collectively, the “Organizer”).

The Terms presented to the Customer at the time of ticket purchase shall govern that ticket and the Customer’s attendance at the Event, subject to applicable law

1. TICKET PURCHASE & TICKET POLICY

All ticket sales are final and non-refundable, except where a refund is expressly required by applicable law or expressly offered by the Organizer in accordance with these Terms.

A Customer's inability, unwillingness, or failure to attend the Event does not create a right to a refund.

This includes, without limitation:

  • Change of plans;
  • Personal emergencies;
  • Transportation issues;
  • Travel issues;
  • Failure to obtain transportation;
  • Weather affecting the Customer's ability to travel;
  • Work or school conflicts;
  • Illness or injury of the Customer;
  • Failure to arrive before the Event ends;
  • Failure to arrive before a particular performer or portion of the Event;
  • Change of mind;
  • Purchase of the wrong ticket;
  • Failure to review the Event details before purchase; or
  • Any other circumstance attributable to the Customer.

Unless otherwise required by applicable law, no refunds, exchanges, credits, or transfers will be provided based solely on a Customer's inability or decision not to attend.


2. TICKET VALIDITY

A ticket constitutes a limited license for admission to the Event identified on the ticket, subject to these Terms and all applicable venue rules.

Tickets may be subject to capacity limitations, security procedures, age restrictions, identification requirements, and other reasonable conditions of admission.

The Organizer reserves the right to invalidate tickets that are counterfeit, duplicated, fraudulently obtained, unlawfully altered, or otherwise invalid.


3. AGE REQUIREMENTS — 20+ ENTRY / 21+ TO DRINK

PROJECT LAZARETH is a 20+ event.

Customers must be 20 years of age or older to enter the Event.

Only Customers who are 21 years of age or older and who satisfy all applicable identification and legal requirements may purchase, possess, or consume alcoholic beverages.

A valid, government-issued photo identification may be required for entry and/or alcohol service.

A ticket purchase does not guarantee admission if the Customer cannot provide acceptable identification or otherwise fails to satisfy the applicable age requirements.

Customers under 20 years of age are not permitted to enter the Event.

Customers who are 20 years old may enter the Event but are not permitted to purchase, possess, or consume alcohol.


4. NO GUARANTEED ENTRY

Purchase of a ticket does not guarantee admission under every circumstance.

The Organizer and/or venue reserves the right to deny admission to, remove, or restrict any Customer when reasonably necessary to protect the safety, security, order, or operation of the Event or venue.

Admission may be denied or revoked for, including but not limited to:

  • Failure to satisfy the Event's age or identification requirements;
  • Violation of these Terms;
  • Violation of venue policies;
  • Intoxication or apparent impairment;
  • Disorderly or disruptive conduct;
  • Fighting or threatening behavior;
  • Harassment;
  • Refusal to comply with reasonable instructions from Event staff or security;
  • Possession of prohibited items;
  • Attempted unauthorized entry into restricted areas;
  • Use of counterfeit or invalid tickets;
  • Fraudulent conduct;
  • Conduct that creates a safety or security concern; or
  • Conduct that materially interferes with the Event or other attendees.


5. DENIED ENTRY & REMOVAL

Except where otherwise required by applicable law, no refund will be provided to a Customer who is denied admission or removed from the Event due to the Customer's conduct, failure to satisfy admission requirements, violation of these Terms, violation of venue rules, or other circumstances attributable to the Customer.

Customers removed from the Event for violating these Terms or applicable venue rules may not re-enter.

Leaving the Event voluntarily does not entitle the Customer to a refund.


6. EVENT CANCELLATION, POSTPONEMENT & RETHROW POLICY

The Organizer reserves the right to cancel, postpone, reschedule, relocate, modify, suspend, delay, or terminate the Event when reasonably necessary.

If the Event cannot take place on the originally scheduled date, the Organizer may, at its discretion:

(a) reschedule or rethrow PROJECT LAZARETH within ninety (90) days of the originally scheduled Event date and honor the Customer's original ticket;

(b) provide the Customer with admission to another Event designated by the Organizer within ninety (90) days of the originally scheduled Event date; or

(c) provide another remedy expressly announced by the Organizer.

Where the Organizer provides a valid replacement Event or rethrow option within the applicable ninety-day period, the original ticket shall be treated as satisfied through the replacement admission opportunity, to the maximum extent permitted by applicable law.

Customers may be required to follow instructions provided by the Organizer concerning ticket validation, transfer, replacement tickets, or admission to the replacement Event.

The Organizer will communicate applicable replacement-event instructions through the ticketing platform, email, website, social media, or another reasonable communication channel.

Nothing in these Terms is intended to waive, eliminate, or restrict a refund or other remedy that is required by applicable law.


7. FORCE MAJEURE

The Organizer shall not be responsible for the failure, delay, interruption, cancellation, postponement, relocation, or modification of the Event resulting from circumstances beyond the Organizer's reasonable control.

Such circumstances may include, without limitation:

  • Severe weather;
  • Natural disasters;
  • Fire;
  • Flood;
  • Power or utility failure;
  • Governmental orders or restrictions;
  • Public-health emergencies;
  • Acts of terrorism;
  • War;
  • Civil unrest;
  • Labor disputes or strikes;
  • Transportation disruptions;
  • Venue closure or loss of venue availability;
  • Security threats;
  • Infrastructure failures;
  • Acts or omissions of third parties; or
  • Other events or circumstances beyond the Organizer's reasonable control.

Where such circumstances occur, the Organizer may exercise the cancellation, postponement, rethrow, replacement-event, or other remedies described in these Terms, subject to applicable law.


8. EVENT CHANGES & LINEUP CHANGES

The Organizer does not guarantee the appearance of any particular artist, performer, DJ, guest, host, attraction, or other participant unless expressly stated otherwise in writing.

Artist lineups, performers, hosts, DJs, set times, programming, schedules, venue arrangements, and other Event elements may change before or during the Event.

The cancellation, substitution, delay, or modification of a particular performer, artist, DJ, guest, host, or portion of the Event does not automatically entitle the Customer to a refund, except where a refund is required by applicable law or expressly offered by the Organizer.

The Organizer may make reasonable changes to the Event without being required to provide refunds solely because of such changes.


9. PROHIBITED CONDUCT

Customers must conduct themselves in a lawful, respectful, and non-disruptive manner.

Prohibited conduct includes, without limitation:

  • Fighting or physical altercations;
  • Threatening or intimidating conduct;
  • Harassment;
  • Hate-based or discriminatory conduct;
  • Sexual harassment or unwanted physical contact;
  • Damage or destruction of property;
  • Theft;
  • Trespassing or unauthorized access;
  • Refusal to follow reasonable instructions from Event personnel;
  • Interference with performers, staff, security, or other attendees;
  • Attempting to bypass security procedures;
  • Possession of prohibited weapons or other prohibited items;
  • Fraudulent or counterfeit tickets;
  • Unauthorized commercial activity;
  • Unauthorized vending or solicitation;
  • Unauthorized professional photography, filming, livestreaming, or recording where prohibited by the Organizer or venue; and
  • Any conduct that reasonably creates a safety, security, or operational concern.

The Organizer and venue may remove any Customer engaging in prohibited conduct without refund, to the maximum extent permitted by applicable law.


10. PROHIBITED ITEMS & SECURITY SCREENING

Customers are prohibited from bringing items prohibited by the Organizer, venue, security personnel, or applicable law.

The Organizer and venue may establish and enforce reasonable security procedures, including inspection or screening procedures consistent with applicable law.

Customers who refuse a lawful or reasonable security procedure may be denied admission or removed from the Event without refund, except where otherwise required by law.


11. ASSUMPTION OF RISK

Attendance at PROJECT LAZARETH is voluntary.

To the maximum extent permitted by applicable law, Customer voluntarily assumes the ordinary and inherent risks associated with attending a live entertainment event, including risks associated with:

  • Crowds;
  • Movement through crowded areas;
  • Dancing;
  • Physical contact with other attendees;
  • Loud or amplified sound;
  • Strobe, laser, lighting, and visual effects;
  • Temporary changes in lighting;
  • Weather conditions;
  • Standing for extended periods;
  • The conduct of other attendees; and
  • Other ordinary risks inherent in attending a live event.

Customer agrees to follow reasonable safety instructions provided by the Organizer, venue, security personnel, and Event staff.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.


12. ALCOHOL

Alcohol may only be purchased, possessed, and consumed by individuals 21 years of age or older who satisfy all applicable identification and legal requirements.

The Organizer and venue reserve the right to refuse alcohol service to any person when permitted or required by law, including persons who appear intoxicated or who violate applicable alcohol-service policies.

A ticket does not include or guarantee alcoholic beverages.


13. PHOTOGRAPHY, VIDEO, AUDIO & MEDIA RELEASE

By entering the Event or Event premises, Customer acknowledges and agrees that the Event may be photographed, filmed, livestreamed, recorded, or otherwise captured in audio or visual media.

To the maximum extent permitted by applicable law, Customer grants the Organizer and its authorized representatives a perpetual, worldwide, royalty-free right to use, reproduce, display, distribute, edit, publish, and otherwise utilize Customer's image, likeness, voice, appearance, or participation captured in connection with the Event for legitimate promotional, advertising, marketing, social media, documentary, archival, or commercial purposes.

Customer understands that the Organizer may use Event footage in future promotional materials without additional notice or compensation.

Customer waives any right to inspect or approve the final use of such media, to the extent permitted by applicable law.


14. PERSONAL PROPERTY

Customer is solely responsible for personal property brought to the Event.

To the maximum extent permitted by applicable law, the Organizer and venue are not responsible for lost, stolen, damaged, or misplaced property.

Customers should not bring valuable or unnecessary personal property to the Event.


15. TICKET TRANSFERS & RESALE

Tickets may not be duplicated, counterfeited, materially altered, or obtained through fraudulent means.

Any transfer or resale of a ticket is subject to applicable law, the terms of the applicable ticketing platform, and any restrictions expressly disclosed at the time of purchase.

The Organizer reserves the right to invalidate tickets obtained through fraud, counterfeit activity, unauthorized distribution, or other unlawful means.

Where a ticket is purchased through a secondary or resale marketplace, the Customer may also be subject to the refund guarantees and policies applicable to that marketplace under applicable law.


16. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the Organizer, its owners, organizers, promoters, producers, employees, contractors, performers, agents, affiliates, representatives, and authorized personnel shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to Customer's attendance at, inability to attend, or participation in the Event.

This limitation includes, to the extent permitted by law, claims involving loss of profits, loss of opportunity, inconvenience, travel expenses, accommodation expenses, transportation expenses, or other consequential losses.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from conduct for which applicable law prohibits limitation of liability.


17. NO GUARANTEE REGARDING PERSONAL EXPERIENCE

The Organizer does not guarantee that any Customer will have a particular experience at the Event.

Customer acknowledges that Event conditions may vary based on crowd size, venue operations, Event programming, security requirements, weather, performer schedules, and other circumstances.

Differences in Customer expectations or personal preferences do not independently create a right to a refund.


18. GOVERNING LAW & JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.

To the extent permitted by applicable law, disputes arising out of or relating to these Terms or the Event shall be brought in a court of competent jurisdiction located in the State of New York.

Nothing in this provision prevents a Customer from exercising any rights or remedies that cannot lawfully be waived or restricted.


19. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision shall be modified or limited to the minimum extent necessary to make it enforceable.

The remaining provisions shall remain in full force and effect.


20. AMENDMENTS

The Organizer reserves the right to modify or update these Terms from time to time when reasonably necessary, including to reflect changes to the Event, venue requirements, security procedures, operational requirements, or applicable law.

For ticket purchases made after updated Terms are posted or presented, the updated Terms will apply to those purchases.

For tickets already purchased, the Terms presented to the Customer at the time of purchase will govern that purchase, except where a subsequent modification is required by applicable law or is reasonably necessary to address circumstances affecting the Event.

Nothing in this section permits the Organizer to retroactively eliminate rights that cannot legally be eliminated.


21. ENTIRE AGREEMENT

These Terms, together with the applicable ticketing terms, venue policies, and other policies expressly incorporated into the ticket-purchasing process, constitute the agreement governing Customer's purchase of a ticket and attendance at the Event.

If any provision conflicts with a mandatory requirement of applicable law, the applicable law shall control.


22. CUSTOMER ACKNOWLEDGMENT

By purchasing or using a ticket to PROJECT LAZARETH, Customer acknowledges that:

  1. PROJECT LAZARETH is a 20+ event;
  2. Alcohol is restricted to individuals 21+ who satisfy applicable identification and legal requirements;
  3. Ticket purchases are final and generally non-refundable;
  4. The Event may be subject to changes, delays, postponement, relocation, or cancellation;
  5. Where applicable, the Organizer may provide a rethrow or admission to another designated Event within ninety (90) days;
  6. Admission may be denied or revoked for violations of these Terms or applicable venue policies;
  7. Customer assumes the ordinary risks associated with attending a live Event;
  8. Event photography, filming, and recording may occur; and
  9. Customer agrees to comply with these Terms and all applicable venue rules.

BY COMPLETING A TICKET PURCHASE, CUSTOMER ACKNOWLEDGES THAT THEY HAVE READ AND AGREED TO THESE TERMS & CONDITIONS.
