Welcome to Speakeasy ("Speakeasy," "we," and "us"). As part of our services, you have the option to use our facial recognition feature (the "Feature") to automatically identify and organize photos of you in your albums and collections. To provide this Feature, we apply facial recognition technology to photos you upload to collect Biometric Information (defined below). Our system then uses this Biometric Information to identify you in other photos within your albums and collections.
Please read this consent carefully. You understand that you are free to decline this Facial Recognition Consent, but that means you won't have access to the Feature. If you decide to proceed with using the Feature, you must agree to this Facial Recognition Consent by checking the facial recognition consent toggle within the Speakeasy application. This toggle will be made available when you are setting up your Speakeasy profile and within the "Privacy Settings" section of your account settings. You can revoke your consent at any time (more information on this below).
The Illinois Biometric Information Privacy Act, 740 ILCS 14/1, et seq. ("BIPA") and certain other state biometric privacy laws regulate the collection, storage, use, disclosure, and retention of "biometric identifiers" and "biometric information." Generally, the term "Biometric Identifier" includes information such as a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry. Biometric Identifiers generally do not include, among other things, physical descriptions such as height, weight, hair color, or eye color. "Biometric Information" includes any information, regardless of how it is captured, converted, stored, or shared, based on an individual's Biometric Identifier, used to identify that individual.
This means that photos of you alone don't constitute Biometric Information. However, when you choose to use the Feature, we will extract certain Biometric Information from photos of you (for example, facial geometry measurements and distinctive facial features) to identify you in other photos within your Speakeasy albums and collections.
When you enable facial recognition, Speakeasy will:
If you are identified in photos within shared albums or collections, your identity may be visible to other users who have access to those albums. This includes album owners and participants who have been granted viewing or editing permissions. You can remove tags of yourself or reject identifications by using the "Remove Tag" or "This isn't me" options when viewing photos.
If you don't consent to our use of your Biometric Information pursuant to this Facial Recognition Consent, or later change your mind, we will delete your Biometric Information from our database. You can learn more about how we handle photo identifications in our Privacy Policy.
Storage and Security: Your Biometric Information is stored in our secure database with industry-standard encryption and access controls. We implement technical and organizational measures to protect your Biometric Information against unauthorized access, disclosure, alteration, or destruction.
Retention: We retain your Biometric Information until the earlier of (i) you revoke your Facial Recognition Consent, (ii) the initial purpose for collecting such Biometric Information has been satisfied, or (iii) three (3) years following your last interaction with Speakeasy. Once these retention periods have expired, your Biometric Information will be permanently and irretrievably deleted from our systems.
No Third-Party Sharing: We do not sell, rent, or share your Biometric Information with third parties for their own commercial purposes. Your Biometric Information is used solely to provide the facial recognition features within your Speakeasy account.

You acknowledge and agree that you have read this Facial Recognition Consent form, and that you voluntarily consent to Speakeasy's collection, retention, use, and disclosure of Biometric Information as set forth herein. By enabling facial recognition in your account settings, you consent to our collection, storage, retention, use, and disclosure of the foregoing information.
